Whole Story Studio: Recording Studio Terms and Conditions
Effective Date: March 1, 2025
Welcome to Whole Story Studio! These Terms and Conditions ("Terms") govern your use of our recording studio services, including but not limited to studio time bookings, studio equipment, and related services. By booking studio time or using our services, you (the "Client") agree to be bound by these Terms. For the purposes of this and future agreements, the term “Studio” refers to Whole Store Studio, LLC, located at 319 Clematis Street #300 , West Palm Beach, FL 33401. Please read the terms carefully.
1. Studio Bookings and Reservations
Booking Process: All studio reservations must be made in advance through the Acuity booking system and/or direct communication with Whole Story Studio (“the Studio”), and are subject to availability. A confirmed booking is only valid upon receipt of a deposit or full payment, as outlined below.
Deposit Requirement: A non-refundable deposit of $100.00 is required at the time of booking. The remaining balance is due before your scheduled session.
Deposit Refunds: In the event of cancellation or rescheduling of a booked recording session or other scheduled services by the Client with less than a 48-hour notice BEFORE the scheduled session, the Client agrees to forfeit the deposit placed to hold the booked session time. For sessions scheduled less than 48 hours before the session, the deposit is non-refundable.
Studio Hours: Studio sessions are available during business hours, 9:00 am EST - 5:30 pm EST. Any studio time outside of these hours may incur additional charges.
Time Slots and Overruns: The studio operates on a strict schedule. If you exceed your scheduled session time, additional fees may apply at the overtime rate of $100/hr. The Studio is not responsible for any delays caused by the client, and the Client will be charged the full amount of the booked studio time.
2. Studio Usage and Client Responsibilities
Studio Equipment: The Studio provides a range of audio equipment, instruments, and technology for your use. The client is responsible for any damage or loss of equipment during the session. All equipment must be used responsibly and according to the manufacturer's instructions. Clients must immediately notify the studio staff of any equipment malfunctions or issues.
Respect for Property: Clients are expected to respect the studio space, equipment, and any other property at 319 Clematis Street. Damages to the studio or any other area at 319 Clematis Street caused by improper handling, misuse of equipment, or irresponsible behavior will result in additional charges.
Studio Staff Assistance: The Studio provides professional staff assistance to ensure a smooth recording process. However, clients must coordinate their sessions, including the setup and direction of the session, with the studio staff.
Conduct and Behavior: Clients and their guests must conduct themselves in a professional manner. The Studio, 1909, and any other resident at 319 Clematis reserves the right to refuse service or terminate a session at any time if disruptive or inappropriate behavior occurs, including but not limited to: smoking, vaping, drug use, harassment, intoxication, or other illegal activity.
Health and Safety: Clients must comply with all applicable health and safety regulations. The Studio reserves the right to deny service if health and safety concerns arise.
3. Liability
Limitation of Liability: Whole Story Studio is not liable for any loss of data, property damage, personal injury, or any other claims arising from the use of our facilities, except where such loss is caused directly by the negligence or willful misconduct of the Studio or its employees.
Client Responsibility for Equipment: The Studio is not responsible for any personal equipment or items brought by the client. It is recommended that clients take necessary precautions to protect their personal property, including hard drives, instruments, or other equipment.
Indemnity: The client agrees to indemnify and hold harmless Whole Story Studio, its employees, contractors, and agents from any and all claims, damages, or liabilities arising from the client’s use of the studio, including but not limited to any third-party claims related to intellectual property infringement, personal injury, or property damage. The Client hereby releases the Studio from any liability for harm or damage that may occur to property, equipment, or persons in Client’s party while on Studio grounds.
4. Cancellations and Rescheduling
Cancellation Policy: Cancellations must be made at least 24 hours before the scheduled session. Cancellations made less than 24 hours before the session will result in a charge of 50% of the total booking fee. Cancellations made within 24 hours of the session will be subject to the full session fee.
Rescheduling Policy: If you wish to reschedule your session, please contact us at least 5 business days in advance. Rescheduling is subject to availability and may incur an administrative fee. The rescheduled session must occur within 90 days of the original booking.
Studio Cancellations: In the event that the Studio must cancel or reschedule your session due to unforeseen circumstances (e.g., equipment failure, illness), you will be offered an alternative session time or a full refund of any deposit paid. The studio will not be held liable for any additional costs incurred by the client due to such cancellations.
5. Intellectual Property and Recording Ownership
Ownership of Recordings: The client retains ownership of all recordings produced during the session, unless otherwise agreed in writing. With client permission, Whole Story Studio retains the right to use portions of recordings for promotional purposes.
Rights to Promotional Materials: The Client hereby agrees that the Studio, under its own discretion, may use their photos, voice, works, name or likeness for purposes of promoting the studio. This will be done through Social Media, Blog, news and any other appropriate platform where a Client’s talent will be showcased for the benefit of the Studio. The Studio upholds in high regard the privacy of the Clients. For this reason, the Studio will never sell, share or download the Client’s recordings without prior written consent from the Client.
Rights to Use Materials: By booking a session, the client warrants that they have the legal right to use any materials (manuscripts, music, lyrics, samples, etc.) they provide to the Studio. The client agrees to indemnify the studio against any claims or disputes arising from the use of third-party materials.
File Backups: The Studio will not back up the Client’s recording files. All session files shall be released to the Client or Client’s representative at the end of the recording session. It is the Client’s responsibility to provide a personal flash/hard drive to the Studio for the purpose of downloading/releasing the recording files to the Client in their entirety. Alternatively, the Studio may transfer all recording files to the Client by attaching a link containing the files and sending them to the Client’s email address of record. Any such link will be valid and accessible to the Client for a period of seven (7) days. On the eighth (8th) day, all files will be permanently deleted unless the Client has made other arrangements with the Studio in advance.
6. Payment Terms
Refunds: The Studio will not issue a refund AFTER a recording session has been performed and/or MP3 or WAV files have been delivered to the Client. Studio rental and other services are also non-refundable.
Payment Methods: The studio accepts payment by: Credit Card (fee applies), ACH, Venmo, Quickbooks transfer, Cash, Zelle. Note: PayPal is not an accepted form of payment. Full payment is required prior to the session unless otherwise agreed.
Late Payment: A late payment fee of $70/week may apply if payment is not received by the due date.
7. Hate Speech and Discriminatory Content Policy
The Client agrees that any content produced at Whole Story Studio will comply with all applicable laws and regulations, including but not limited to those prohibiting hate speech, discrimination, and incitement to violence. The Studio reserves the right to reject or terminate any booking or project, at its sole discretion, if the content being produced promotes or incites hate speech, violence, discrimination, racism, sexism, bigotry, or any other form of harmful, unlawful, or offensive material.
Whole Story Studio defines "hate speech" as any speech, gesture, conduct, writing, or display that incites violence, discrimination, or hostility towards individuals or groups based on race, ethnicity, religion, national origin, sexual orientation, gender identity, disability, or other protected characteristics.
If the content being recorded is found to violate this policy at any point during production, Whole Story Studio reserves the right to immediately cease work and remove the client from the premises, with no obligation to refund any fees paid. The Client further agrees to indemnify and hold Whole Story Studio harmless from any legal or financial consequences arising from the creation or distribution of any prohibited content.
By booking and utilizing services at Whole Story Studio, the Client acknowledges and accepts this policy.
8. Amendments to Terms
Whole Story Studio reserves the right to modify or amend these Terms at any time. Any changes will be communicated to clients in advance, and the updated Terms will apply to all new bookings made after the modification date.
By booking a session at Whole Story Studio, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you have any questions or concerns, please contact us at julie@wholestorystudio.com. Any violation of these terms and conditions by the Client or any member of the Client’s party is grounds for immediate termination of this agreement. At such time that this agreement is terminated, Client and all persons included in Client’s party shall be escorted from the property and the Client forfeits all deposits already paid to the Studio. Client will then be banned from use of the Studio’s facilities. The Studio or Studio Representative reserves the right to refuse service to anyone and/or determine when a violation of these terms has occurred.
